Licitações na administração pública: Nova perspectiva para a qualificação econômico-financeira de empresas na contratação de serviços de engenharia e obras civis

Este artigo tem por objetivo realizar uma análise crítica dos procedimentos licitatórios adotados pelo Poder Judiciário Paranaense com ênfase na etapa de qualificação econômico-financeira visando o aumento da eficiência do processo. A partir da decomposição da etapa de qualificação econômico-financeira em sete perspectivas, foi realizada a análise crítica à luz das expectativas dos gestores de melhoria. Utilizou-se a metodologia de pesquisa-ação, com início do projeto em julho/2011. Os resultados do estudo conduziram a implantação de nova matriz de requisitos para os editais de licitações para contratações de serviços e engenharia e obras civis constituídos na modalidade de Concorrência Pública. Foram incluídos indicadores que revelavam o Patrimônio Líquido já vinculado a outras licitações, a disponibilidade líquida patrimonial, o Patrimônio Líquido atualizado, indicadores de endividamento e ainda ajustes de acordo com a Lei nº 11.638/2007 quanto às Demonstrações Contábeis exigidas. Nos exercícios de 2011 e 2012, foram realizadas mais de 50 editais de licitação com a proposta dos pesquisadores. Constatou-se que, embora o novo modelo de edital tenha exigido mais tempo de análise, os novos elementos inabilitaram empresas que não atendiam aos requisitos considerados indispensáveis à segurança mínima do Órgão nas licitações, revelando-se efetivo quanto ao aumento da eficiência.
